PURPOSE AND LEGAL BASIS FOR PROCESSING
Your personal data will be processed:
in the case of recruitment that may result in employment on the basis of an employment contract:
- with regard to personal data specified in the labor law, which the employer requires from the person applying for employment – in order to fulfill legal obligations resulting from labor law, related to the recruitment process, primarily the Labor Code – the legal basis for processing is a legal obligation of the Controller (Art. 6 (1) (c) of the General Data Protection Regulation (GDPR) no. 2016/679, in connection with the provisions of the Labor Code),
- with regard to personal data not required by law – the legal basis for processing is consent (Art. 6 (1) (a) of the GDPR). in the case of recruitment that may result in employment on the basis of a civil law contract:
- in order to conduct the recruitment process currently conducted by the Controller – the legal basis for processing is the Controller’s actions taken prior to the possible conclusion of the civil law contract (Art. 6 (1) (b) of the GDPR);
- in order to conduct the recruitment process currently conducted by the Controller for an internship – the legal basis for processing personal data is the Controller’s actions taken prior to the possible conclusion of the civil law contract (Art. 6 (1) (b) of the GDPR); for the purposes of conducting future recruitment processes, in the case of giving consent(s) to process personal data for this purpose – the legal basis for processing is consent (Art. 6 (1) (a) of the GDPR); in order to establish or defend against potential claims by the Controller – the legal basis for processing personal data is the legitimate interest pursued by the Controller (Art. 6 (1) (f) of the GDPR);
RECIPIENTS OF PERSONAL DATA
Your personal data will be disclosed to entities providing services to the Controller in connection with the management and support of the recruitment processes, as well as to suppliers of IT systems and IT services and legal services.
PERIOD OF RETENTION OF PERSONAL DATA
To the extent that the processing of personal data is based on the consent(s) given – the personal data will be processed until its withdrawal. The withdrawal of consent shall not affect the lawfulness of the processing carried out before the withdrawal. In the case of giving consent to process personal data contained in the job application for the purposes of future recruitment processes, your personal data will be used for a period of up to 12 months from the date of giving the consent. In the case of processing data for the purposes of the current recruitment process and selection of a candidate or candidates by the Controller, the data will be processed for the period necessary to conduct the recruitment process (or until the withdrawal of consent for additional data). The processing period may be extended each time until the end of the duration of the first temporary contract concluded with the selected candidate as part of the given recruitment process. In justified cases, the limitation period for claims may be extended if the processing of your personal data is necessary to establish or defend against potential claims by the Controller. After this period, the data will only be processed to the extent and for the time required by law.
RIGHTS OF DATA SUBJECTS
You can withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of the processing carried out before the withdrawal. For evidentiary purposes, the Controller requests that the withdrawal of consent be made in writing to the address of its registered office or electronically to the following address: worktime@interia.pl. You have the right to:
- request access to your personal data,
- request rectification of your personal data,
- request erasure of your personal data,
- request restriction of processing of your personal data,
- object to the processing of your personal data (when the legal basis for the processing of personal data is the Controller’s legitimate interest),
- data portability (when the legal basis for the processing of personal data is your consent, the performance of a contract to which you are a party, or steps taken at your request prior to entering into a contract),
- lodge a complaint with a supervisory authority, i.e. the President of the Personal Data Protection Office.
INFORMATION ABOUT THE OBLIGATION TO PROVIDE DATA
Providing personal data indicated in labor law as data that the employer demands from a job applicant is required by the Administrator for the purpose of conducting recruitment. The consequence of not providing these data is the inability to consider your candidacy in the recruitment process. Providing personal data other than those indicated in labor law is voluntary.
